• Check-in/Check-out: Standard check-in time is 14:00 and checkout time is 12:00.
• Day use rooms (up to 18:00hrs) are bookable one (1) day prior to departure and will be subject to availability at the guesthouse. Day use rooms will be chargeable at half the prevailing daily rate. Guests’ stays after 18:00hrs will be considered as a full night accommodation and charged accordingly.
• Garden view rooms, rooms with balcony, and double rooms: 2 adults and 1 child (under 10 years). • Family room: 3 adults and 1 child (under 10 years).
• Cancellation Policy: The AGENT agrees to the cancellation policy stipulated in this agreement.
• The rates are based on Bed and Breakfast.
• A 10% service charge fee and applicable GST will be charged on any additional services guests avail from the guesthouse not stipulated in this contractual agreement.
• Green tax of USD 3.00 per person per night is not included in the rate.
• Service charge is presently levied at 10%, GST at 16%, and Green tax at US$ 3.00 per person per night.
• If the rate of GST and Green tax increases or any new taxes or levies are imposed by the Maldives Government, such increases will be added to the above rates at the time of invoicing.
• We will also be entitled to deduct any withholding taxes on any payments to you if required to do so under any statutory regulations in Maldives.
• Partner shall ensure that a minimum mark up of 5% is added and maintained on top of the Contracted Rates. Partner agrees to abide by this minimum selling price or MSP.
• Airport transfer rates are supplied in clause 4. under Supplementary charges and also subject to applicable GST and Service Charge.
• Transfers cannot be arranged by the Partner and all guest transfers need to be booked via the guesthouse.
• Guest’s International Flight details should be received at least four (4) days prior to arrival in order to arrange transfers.
• The guesthouse disclaims any and all liability as a result of force majeure and/or acts of God, including but not limited to natural disasters. The guesthouse is solely purchasing the services of the speedboat operator on behalf of the Partner.
• Should the speedboat operator revises its transfer rates or impose any additional fuel charges; the guesthouse shall provide that information to the Partner within seven (7) working days from the date the information is received by the guesthouse in writing. Upon notification the rate amendment will become immediately effective for all bookings.
• Early departure: No refunds

• Any cancellations or amendments to reservations are to be received in writing and confirmed in writing by the guesthouse with a cancellation number. This applies to all reservations. Cancellation charges will be applied if amendments and cancellations are received after the release period, which will also be applicable for forecast reservations and option bookings on stop sale lists.
• Any booking amendment, name change, or date change for stop sale dates will be treated as a new booking. Thus, the original booking will be cancelled and new bookings may be accepted subject to availability.
• The Partner shall feature the guesthouse in its marketing programs and brochures and where appropriate also include therein a high-quality colour photograph of the guesthouse. Brochure descriptions as well as brochure photographs must be approved by the guesthouse in writing before going to print. In the absence of such approval, the guesthouse will not be liable or committed to items that are not part of this contract and might decide to stop sales for the remaining period of the Contract.
• The guesthouse reserves the right to carry out repairs, renovations and/or upgrade/preventive maintenance programs as it may deem fit, in order to keep the guesthouse in good condition. The decision to renovate/upgrade shall be made by the guesthouse as its absolute discretion, but prior notice of commencement of any major renovation work, on a prolonged basis, that may affect guests’ comfort, will be given to the Partner.
• The guesthouse agrees to provide and make available for the exclusive use of the Partner, the rooms, facilities, meals and other services specified in this contract, during the period and at the price specified herein together with any other arrangements that may be agreed upon in writing.
• The guesthouse guarantees that the services will always correspond to the standard and service of its category and classification. If the guesthouse for some exceptional reason during the contractual period cannot fulfil its obligation to accommodate guests confirmed by the guesthouse in conformity with this contract, the guesthouse will offer these clients, with the approval of the Partner, an alternative arrangement or guesthouse with equivalent or higher standard at the expense of the guesthouse. The guesthouse will bear all extra costs related to such alternate arrangements provided to such clients.
• The guesthouse hereby agrees and certify that the guesthouse complies fully with the national, local and trade regulations relating to hygiene, fire, and the general safety of those using the guesthouse, in all respects and will hold the Partner and its employees, agents, representatives, clients and all other third parties indemnified against any claims, loss, expenses or costs incurred or arising as a result of any failure on the part of the guesthouse to comply with such regulations or laws.
• The guesthouse will not be responsible for unfulfilled contractual obligations that result from force majeure or circumstances beyond the control of the guesthouse. Such occurrences include late arrival or departure of domestic or International Flights, hurricanes, storms, tidal waves, floods, cases of war, insurrection, political upheaval, labour dispute, strikes, laws or regulations, boycotts, epidemics, contagious diseases or other circumstances of whatever kind or nature that unfavorably affects the operation of the guesthouse.
• All information contained in this Contract is deemed confidential and shall not be disclosed to a third party for whatever reason, without the written agreement of the guesthouse. The guesthouse reserves the right to terminate this contract if this confidentiality has been deemed broken.
• This Contract shall be governed and construed in accordance with the laws of the Republic of Maldives and the Parties hereto submit to the exclusive jurisdiction of the courts of the Republic of Maldives.
• Rates Confidentiality: Rates quoted are confidential and shall not be published on the internet.
• Force Majeure: Obligations in this agreement will be rendered invalid in circumstances of force majeure such as civil unrest, war, strikes, natural catastrophes, acts of terrorism, and government ordered measures.
• Renovations: Sun & Surf reserves the right to carry out repairs, renovations, or upgrades as deemed necessary. Prior notice of any prolonged or major renovation work will be communicated to the AGENT/Operators.
